Civil Court Procedure
The Courts in Scotland are available to members of the public which allows them to make claims or raise actions against other individuals or organisations. We refer to these as the Civil Courts. Knowing the right procedure for your case is the starting point of any claim. There are three main procedures available: Small Claims, Summary Cause and Ordinary Actions. When raising an action, the type of claim and the value (if applicable) will then allow our team to advise you as to which procedure is appropriate to your case. Legal Aid is always available for some but not all types of action. It is therefore important to seek legal advice as early as possible to make sure the right option is selected, and to check if funding is available from the Scottish Legal Aid Board. Our team is here to advise you and guide you through any Civil Court Procedure that you may be part of, whether you are asking the Court to grant Orders or looking to defend an action raised against you.
Personal Injury
If you have suffered an injury as a result of the actions of a third party you may be entitled to compensation. There are different types of personal injury claims depending on who is at fault, and the value of the claim. Due to the complex legal issues that have to be explored, we recommend that legal advice is sought before any action is taken. Our team can go through the details of your claim and offer sound advice as how best to proceed. We will also assess whether you are entitled to Legal Aid to assist you with your claim.
